Unless stated otherwise, the price detailed on the relevant Product Page refers to purchasing one item of the specified size, regardless of the number or size of items displayed in the images for that product. There are no hidden extra costs. Prices are subject to change without prior notice. ORDERING One of the priorities for the design of this site was to make purchasing a smooth and easy process taking place in a reassuringly secure payment environment. And so ordering from us is very safe and straightforward. You can order - on-line - by phone - by post - by email If you would like to make a purchase, please specify the size, colour and quantity on the relevant product's Product Page and submit your choice to the Order Page by clicking on the 'BUY' button. When you have completed your choice of product(s), your order value will be displayed. You can specify your choice of non-standard delivery service if required and you are given the opportunity to supply us with any special instructions or information with regards to your order which, if in any way possible, we will be happy to take into consideration. You are then invited to make your payment. Alternatively, you can send us your order details by email and pay over the phone or by bank transfer (see PAYMENT). We cannot accept orders from any person younger than 18 years of age without the consent of that person's parent or carer.
Please make sure that the billing address you enter matches the exact address details your card issuer holds (as showing on your card statements), otherwise your payment will not be authorised by HSBC. You will then be returned back to our website and be issued with a transaction confirmation. We will always require cleared payment in order to start processing your order and any outstanding balances must be paid prior to delivery. If for any reason an invoice becomes overdue for payment, the full outstanding account is immediately due and payable. We reserve the right to charge interest on overdue amounts at 3% above HSBC's base lending rate for the time being in force calculated on a daily basis. Payment shall be deemed to have been received only when the full amount of the value of the goods as invoiced (plus interest) has been credited to our bank account without recourse or we have received the full amount in cash. Standard UK Delivery costs are included in our prices. This type of delivery will arrive at your specified delivery address realistically anytime between 7.30 am - 6.30 pm during the day the delivery is arranged for and includes England, Wales, and Southern and Central Scotland. If your delivery address is outside the UK, please contact us for a shipping quote. Delivery times count from the moment your payment has cleared and you have received our Order Confirmation. RETURNS You will love our products, we are very sure. But in the very unlikely event that you are not completely satisfied with your order, you must notify us strictly within 3 working days of delivery, detailing the reason for your dissatisfaction. No goods are to be returned to us without prior notification and without our strict authorisation. Goods which are unused, undamaged, in their original packaging and fully marketable, may be returned strictly within 14 working days from delivery. We unconditionally reserve the right not to refund if the goods are not returned in an 'as new' condition. The goods must be in their original packaging as received from us, neatly cared for and in immaculate condition. More specifically, we cannot accept returned items which fall into the following categories: - any personalised goods or goods made to your specification, - any items which have been used in any way and are no longer suitable for resale, - any items which have been stained, damaged in the wash or wrongly treated, - any packages where the postage is unpaid. For goods returned to us any later than 14 working days from delivery, please note the following: - For returned goods received by Within4Walls between calendar days 15 and 21 after initial delivery to you, you will incur a 10% administration charge. - For returned goods received by Within4Walls between calendar days 21 and 28 after initial delivery to you, you will incur a 50% administration charge. - Goods returned to Within4Walls after 28 days will not be refunded. Many of our products are made-to-order goods of high value. Orders for these goods are classed as CUSTOM ORDERS, notice of which is given on the Product Page of each product. At our discretion we will accept the return of made-to-order goods, but any shipping/delivery costs incurred by Within4Walls as well as a minimum stocking fee of 10% will be deducted from your refund. Unless there is a manufacturing fault or they were damaged in transit (see Damaged Goods), authorised goods need to be returned to us at your own cost. Refunds are made for the cost of the goods excluding any Postage and Packing. Where you have made your own arrangement for the return, the goods must be fully insured during transit and must be adequately packed in the original packaging to prevent damage. Within4Walls cannot be held liable for any damages or losses in the return transit service. In general terms, the company who delivered your items to you should also be used for returns. Please make sure the offered compensation for loss or damage covers the value of the goods to be returned. If you are in any doubt, please contact us. EXPORT and IMPORT ORDERS Unless there is a manufacturing fault, or damage occurred in transit (see Damaged Goods), where an authorised refund concerns a Custom Order consisting of items of high value, which were imported into the UK or exported from the UK specifically for your order and on your request, we reserve the right to deduct any shipping and delivery costs incurred by Within4Walls from your refund. Where an order involves goods to be exported outside the UK, we guarantee that these goods will leave the UK in perfect condition and full working order. However, once delivery has been made, installation and - if required - assembly of your order will be entirely your, our client's, responsibility and we will not be held liable for damage to any incorrectly handled or incorrectly fitted products. For more complex, very large or bespoke products, we can quote for a full installation service. CANCELLATIONS Our legal obligation to you, our customer, under the European Directive incorporated into UK Law by The Consumer Protection (Distance Selling) Regulations 2000, is to grant you the unconditional right to cancel your order from the date of the contract and up to the point where you have been contacted to arrange delivery and arrangements for delivery have been agreed. Should you make a cancellation beyond this point, we will deduct your refund with the amount of any delivery charges and cancellation penalties which Within4Walls may have incurred as a direct result of your order cancellation. Many of our products are made-to-order goods of high value. Notice is given with the relevant product specifications that orders for these goods are classed as CUSTOM ORDERS and may only be cancelled strictly within 1 week of ordering, as work on the product by then will have started. Any cancellations beyond this point will lead to your refund being deducted by the amount of any cancellation penalties which Within4Walls has incurred as a direct result of the cancellation of your order. Cancellations should be made by telephone only. We will make a refund to you within 30 days of the cancellation. DAMAGED GOODS Should the product you ordered be incomplete, show a manufacturing fault or have been damaged in transit, you need to notify us in writing (fax or email) strictly within 3 days of delivery. We can then either - replace the defective product as soon as possible depending on the nature of the product/order, or - offer you a full refund within 30 days. Where the defect or damage is readily visible, this should be highlighted at the time of delivery. We shall be under no liability whatsoever in respect of any defect caused by fair wear and tear, by negligence or wilful damage, by failure to follow our instructions or those given by the supplier, by alteration of the goods without our approval or by any other act of misconduct by third parties. WARRANTY All goods sold by us are warranted free from defects in material and workmanship. In the very unlikely event that you should find goods to be defective in respect of materials or workmanship only, you need to notify us in writing within 3 days of delivery of the goods. We will investigate and examine the goods and to our discretion either replace the defective goods or refund the purchase price (see Damaged Goods) We will not be liable for any goods which have been repaired or altered in any way or have been the subject of any accident or damage caused by any innocent, willful or negligent act by you or through use of the goods not in accordance with the manufacturer’s instructions. We strongly advise you to employ professional tradesmen (e.g. electricians, carpenters, plumbers) with regard to the installation of goods of the type which need to be installed properly and safely in accordance with manufacturer’s instructions and codes of practice. RISK and PROPERTY No property or title to goods shall pass to you unless and until the full amount of the value of the goods as invoiced has been credited to our bank account without recourse or we have received the full amount in cash. Risk of damage to or loss of the goods shall pass to you at the time of delivery or attempted delivery or, if you wrongfully fail to receive the delivery as arranged, at the time when Within4Walls has tendered delivery of the goods. COMPLAINTS We want you to be completely satisfied with the products you purchase from us and the service we offer. If there is anything not to your satisfaction please let us know immediately so that we can act accordingly and effectively. We aim to respond to all complaints within 2 working days. CONFORMITY OF GOODS We take every possible care to make sure that the descriptions, specifications and colours of our products are correct. However, while the colour reproduction of the products is a very close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you. Due to the individual and often handmade nature of our products, slight colour and size variations are always possible. However, these variations will not alter the overall appearance or dimensions of the products. Although we aim to give you reliable and up-to-date product specifications and service information, the pages contained in this site may contain technical inaccuracies and typographical errors. Although closely monitored, the information in these pages may be updated from time to time and at times may be out of date. We accept no responsibility or liability for this. SECURITY and PRIVACY By providing personal data to us, you consent to the processing of your data by us as described in this Privacy Policy. We are committed to protecting your privacy. We do not send random marketing material to private email addresses (spam) and we will not pass on any of your details to any third parties. We only collect data which is adequate, relevant and not excessive in relation to our purpose of processing your order, and we do not keep this data for longer than necessary. We will only use the information that we collect about you lawfully and in accordance with the 1998 Data Protection Act and we ensure you that all information is held securely. You have the right to request access to the information held by us and this information will be revealed to you, or deleted should you wish so, within 40 days maximum of receiving your request. Your credit/debit card details will not be seen or held by us (see Payment). In order to process your order it may be necessary to disclose your contact telephone number to our delivery company in case they need to contact you. Although we do give you the opportunity to provide us with more detailed personal information about yourself through our Customer Profile Form, we assure you that these details will not be of a sensitive nature, that they will be held securely in accordance with our own internal security policy and with the rules laid down by the Data Protection Act, and that we may use your details for the sole purpose of - improving customer services within our company only, - informing you about new products and services, promotions or exclusive offers brought to you by Within4Walls, - for our own internal statistical analysis only. At each point of data collection on our website you are given the opportunity to opt-out of receiving material from us. Within4Walls use Secure Server software to protect the data you provide each time you place an order. This software encrypts the computer data and messages by means of a 'key', so that it can be reconverted only by an authorised recipient holding the matching 'key'. This minimises the risk of the data being intercepted before we receive it. Credit/Debit card information is subject to 128-bit encryption, which is the highest level protection available against fraud. We cannot guarantee that the service will be provided fault-free and we do not undertake or warrant that the service will be free from defects. We may temporarily have to suspend the service either partially or completely for any reason. We will restore the service as soon as reasonably practicable after a suspension. We will not be liable to you for any loss which you incur as a result of any such suspension. The information contained in the material in this site is for information purposes only. We will not be liable for being prevented from carrying out our obligations as a result of any cause beyond our control (e.g. War, Flood, Strikes, Acts of God, Technical Failure etc) and we shall be relieved of our obligations and liabilities for as long as such fulfilment is prevented. GOVERNING LAW This agreement shall be governed by and construed in accordance with the law of England and Wales and each party agrees to submit to the jurisdiction of the English Courts. CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 1999 The Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement. ENTIRE AGREEMENT These terms and conditions contain the whole agreement between the parties and supersedes any other written or oral agreement between the parties and the parties confirm that they have not entered into this agreement on the basis of any representations that are not expressly incorporated into this agreement. |
